Terms and Conditions

This Publishing Agreement (“Agreement”) governs the relationship between the Author and Online University Press, the company owning and operating the website www.onlineuniversitypress.com (“Publisher”).

By submitting a thesis or research work for publication, the Author declares to have read, understood, and accepted the terms set forth below.

1. Ownership of Rights

The Author declares and guarantees that they are the sole and legitimate holder of all copyright and moral rights in the thesis or research work submitted (“Original Work”).

Nothing in this Agreement shall be interpreted as a transfer of ownership. The Author remains, at all times, the exclusive owner of the copyright in the Original Work.

2. Nature of the Publication

The Author acknowledges that Online University Press does not publish university theses as deposited academic documents.

The publication consists of a revised, adapted, edited, and formatted derivative work based on the Original Work (“Published Work”), intended for commercial distribution and readership beyond the academic context.

2-bis. Transparency on Academic Use and Purpose of the Service

The Author acknowledges that the publication of the Published Work under this Agreement constitutes a form of commercial dissemination and not an academic publication in the strict scholarly sense.

The purpose of this service is to offer the Author the opportunity to give a second life, broader visibility, and public accessibility to a thesis or research work that would otherwise remain confined to institutional repositories or personal archives, without the intent of substituting or replicating traditional academic publishing pathways.

The Author further acknowledges that the publication of the Published Work may be considered a form of prior publication and may affect the Author’s ability to publish the same work, or closely related versions thereof, with academic publishers, peer-reviewed journals, or within doctoral or academic evaluation contexts.

The Publisher does not represent this service as a peer-reviewed academic publication and encourages Authors to carefully consider their academic and professional objectives prior to submission.

3. Grant of Rights (Non-Exclusive License)

The Author hereby grants to Online University Press a non-exclusive, worldwide, royalty-based license to:

– edit, adapt, format, and prepare the Published Work;

– publish, reproduce, distribute, and sell the Published Work in digital (eBook) and print formats;

– distribute the Published Work through http://www.onlineuniversitypress.com, Amazon Kindle Direct Publishing (KDP), and any other online platforms or distribution channels deemed appropriate by the Publisher.

This license is non-exclusive. The Author retains the right to use, publish, or license the Original Work or derivative versions thereof with third parties, subject to any obligations arising from institutional or contractual commitments.

4. University Policies and Third-Party Rights

The Author declares that the submission and publication of the Published Work do not violate any university regulations, institutional policies, funding agreements, or third-party rights.

The Author acknowledges that universities typically retain non-exclusive archiving or open-access rights and confirms that such rights do not prevent the commercial publication of a revised and derivative work.

Any responsibility related to compliance with university or institutional policies remains with the Author.

5. Editorial and Production Activities

The Author authorizes Online University Press to:

– format the manuscript for eBook and print-on-demand publication;

– design the cover and internal layout;

– include publishing details, ISBN information, and credit pages;

– conduct originality and plagiarism checks.

The Publisher may consult the Author regarding editorial or design choices but retains final decision-making authority for publication standards.

6. Metadata and Promotion

The Author agrees that the following information may be displayed and used for promotional and commercial purposes:

– title and subtitle of the Published Work;

– abstract or description provided by the Author;

– table of contents;

– Author’s name and optional biography;

– keywords, categories, and metadata required for online distribution.

7. Royalties and Payments

Online University Press shall pay the Author 30% of net revenues received from the sale of the Published Work, after deduction of platform fees, taxes, printing costs, and transaction costs. The remaining 70% constitutes the Publisher’s commission.

The Author agrees that initial revenues may be retained by the Publisher to cover production and formatting costs (around €50).

Payments shall be made annually by the end of the year, provided that the Author’s accrued royalties reach a minimum threshold of €50.00. Amounts below this threshold shall be carried forward to subsequent accounting periods.

Upon request, the Publisher shall provide the Author with a summary statement of sales and royalty calculations for each accounting period.

8. Term and Termination

This Agreement shall remain in force until terminated by either party.

Either party may terminate the Agreement by written notice via email, with at least one-hundred-and-eighty (180) days notice.

Upon termination:

– the Published Work shall be removed from the Publisher’s website and distribution platforms within a reasonable timeframe;

– production materials shall not be returned;

– any outstanding royalties shall be settled according to the terms above.

If termination occurs before production costs are recovered, the Author agrees to reimburse fixed costs for €50 prior to delisting.

9. Liability and Indemnification

The Author warrants that the submitted work is original, lawful, and does not infringe any third-party rights.

The Author agrees to indemnify and hold harmless Online University Press from any claims, damages, or liabilities arising from breaches of this warranty or from improper use of the work by third parties.

10. Data Protection

The Author authorizes the processing of personal data in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation – GDPR) and Italian Legislative Decree No. 196/2003, as amended, for purposes related to the execution of this Agreement and the publication and distribution of the Published Work.

11. Governing Law and Jurisdiction

This Agreement shall be governed by Italian law.

Any dispute arising from or related to this Agreement shall fall under the exclusive jurisdiction of the competent Italian courts.

12. Final Provisions

By submitting the work via www.onlineuniversitypress.com or the Publisher’s official email address (onlineuniversitypress@yahoo.com), the Author confirms acceptance of this Agreement and declares full legal capacity to grant the rights herein.
